Retiring in Portugal: Visa Options and Processes

Retiring in Portugal has become an increasingly attractive option for many foreigners looking to enjoy a peaceful, affordable, and culturally rich lifestyle. Portugal offers several visa options for retirees, each catering to different needs and circumstances. At RME Legal, we specialize in helping clients navigate the complexities of immigration law to secure their retirement in this beautiful country. This guide provides a comprehensive overview of the main visa options available for retirees: the D7 Visa, the Golden Visa, and the EU Certificate (including Article 15 for family members).

D7 Visa: The Passive Income Visa

The D7 Visa, also known as the Passive Income Visa, is designed for individuals who can demonstrate a regular passive income. This is a popular choice for retirees who receive pensions, rental income, or other sources of stable income.

Eligibility Criteria

  • Proof of sufficient passive income to support yourself during your stay in Portugal.
  • A minimum income threshold, which is generally the Portuguese minimum wage (€9,840 per year as of 2024).
  • Accommodation in Portugal (rented or owned).

Application Process

  1. Gather Documentation: Collect documents such as proof of income, passport, criminal record certificate, health insurance, and proof of accommodation.
  2. Submit Application: Apply for the D7 Visa at the Portuguese consulate in your home country.
  3. Attend Interview: Attend an interview if required by the consulate.
  4. Receive Visa: Upon approval, you will receive a visa allowing you to enter Portugal.
  5. Apply for Residence Permit: Once in Portugal, apply for a residence permit at the local AIMA (Agência para a Imigração e Mobilidade de Asilo) office.

Golden Visa: The Investment Visa

The Golden Visa program is ideal for retirees who wish to invest in Portugal while securing residency. Note that real estate investment is no longer an option under the Golden Visa program, but several other investment options are available.

Eligibility Criteria

  • Capital transfer of at least €1.5 million.
  • Creating at least ten jobs in Portugal.
  • Investment of at least €500,000 in company creation, research activities or in cultural heritage.

Application Process

  1. Choose Investment: Decide on the type of investment (capital transfer, job creation, research, or cultural heritage).
  2. Make Investment: Complete the investment and gather all necessary documentation.
  3. Submit Application: Apply for the Golden Visa at the Portuguese Immigration and Borders Service (AIMA).
  4. Attend Biometrics Appointment: Attend an appointment to provide biometric data.
  5. Receive Visa: Upon approval, receive your Golden Visa, which allows free movement within the Schengen Area.
  6. Renew Residency: Renew your residency permit every two years by proving that the investment is maintained.

If you would like to understand the diferences between the D7 Visa and Golden Visa, please consider it mostly reffers to minimum stay requirements. Under the D7 visa you are supposed to spend significant time in Portugal, becoming a resident for tax purposes; under the Golden Visa, you have the option of staying for short periods and avoid any tax implications.

EU Certificate: For EU Citizens and Article 15 for Family Members

For EU citizens, retiring in Portugal is a straightforward process thanks to the EU’s freedom of movement policies. Family members of EU citizens can also benefit from these provisions under Article 15.

EU Citizens

  • Registering Residency: EU citizens need to register their residence at the local town hall (Câmara Municipal) within 120 days of arrival.
  • Documentation: Provide proof of identity, health insurance, and sufficient financial means.

Family Members (Article 15)

  • Eligibility: Non-EU family members of an EU citizen residing in Portugal.
  • Application Process:
    1. Proof of Relationship: Provide proof of family relationship (marriage certificate, birth certificate, etc.).
    2. Register with AIMA: Apply for a residence card at the AIMA office, attending an appointment to provide biometric data.
    3. Receive Residence Card: Upon approval, receive a residence card valid for five years.
